Executive Summary
On June 2, the White House signed Executive Order 14409, creating a “voluntary” pre-release review of the most capable AI models and explicitly ruling out any licensing requirement.
Within three weeks, Anthropic and OpenAI each had a release decision effectively made for them by Washington one under a mandatory export-control order, one under informal request neither running through the EO’s own channel.
The EO’s own machinery, a classified process for designating “covered frontier models,” isn’t due until August 1. Informal leverage arrived first.
The live question isn’t whether a lab must join the review program. It’s how many other levers already reach the same outcome without it.
Proximity to the federal trust network is becoming a durable business asset, independent of whose model performs better.
